1. ACCEPTANCE OF TERMS

NCS Online Resources, LLC ("NCS"), owners of Office-Pools.com, provides its services to you, subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS at any time on our website. In addition, when using Office-Pools.com services, both you and NCS shall be subject to any posted guidelines or rules applicable to such services which may be changed from time to time. All such guidelines or rules are hereby incorporated by reference into the TOS.

2. DESCRIPTION OF SERVICE

Office-Pools.com provides users with a web-based software application for creating and managing sports and events pools, including but not limited to, professional football, college football, college basketball, and auto racing. NCS reserves the right to alter its supported events, as well as the mechanisms in which users are ranked at any time. The use of Office-Pools.com's services is intended for entertainment purposes only. NCS does not endorse illegal gambling and the services offered by Office-Pools.com should not be construed as supporting illegal gambling. NCS and Office-Pools.com are neither affiliated with nor endorsed by any professional sports organization. NCS is neither responsible nor liable for any telecommunication or internet service costs you incur while using our service.

3. POOL OWNERSHIP

All pools on Office-Pools.com are considered to be owned by the pool administrator. It is the responsibility of the administrator and pool members to ensure that the pool meets all local, state and federal legal requirements. If the pool has a prize, it is the sole responsibility of the individual pool administrator to award that prize. Office-Pools.com is neither responsible nor liable, in any way, shape or form, for awarding pool prizes. NCS is neither responsible nor liable for ensuring the legality of a pool.

4. SUBSCRIPTION-BASED LICENSE MODEL

There is no charge or fee to create and manage individual user accounts. License Subscriptions are sold to allow users to participate in pools. This allows a pool administrator to run a pool on Office-Pools.com without inconveniencing players to have to pay as they sign up for the site or the pool.

User subscription licenses are sold in either season-long or single-event packages. A season-long package extends from the beginning to the end of any ONE season for a specific sports league. Seasons are defined as commonly understood by fans, and end with the conclusion of the championship game or event for that season in that league.

A license is required for each pickset in your pool. So if a player is playing multiple picksets (up to three per login for each season and league are allowed) he or she will consume multiple licenses.

Failure to purchase adequate licenses to cover the number of players in your pool will render the pool unusable until payment has been made.

5. SATISFACTION GUARANTEE

We are confident that you will find the services offered on Office-Pools.com to be a real improvement over the way you’ve run your pool in the past. We have hundreds of testimonials from customers telling us how great the site is, and we intend to keep improving it.

However, if you are not satisfied with the services offered by Office-Pools.com for any reason you may request a refund within 15 days of purchase. Your money will be refunded, less any processing fees, and your pool will be deleted. Notification of the deletion to players is the responsibility of the pool administrator.

You may request a refund via email by contacting Office-Pools.com Commissioner or you may request a refund via mail.

6. PRIVACY POLICY

Office-Pools.com only keeps user information on file in order to facilitate communication between NCS, Office-Pools.com, administrators, and players in a pool. We will not sell or rent our membership list to anyone. However, by signing up on Office-Pools.com and using our service you consent to periodic communications from us about new services or features offered through Office-Pools.com. These messages are sent at most four times a year.

7. USERNAME, PASSWORD AND SECURITY

You are responsible for maintaining the confidentiality of your username and password, and are fully responsible for all activities that occur under your username. You agree to ensure that you log off from your account at the end of each session, or otherwise protect access to your OP account. Office-Pools.com cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

8. LOCATION OF LAWSUIT

You and Office-Pools.com agree to submit to the personal and exclusive jurisdiction of the courts located within Hillsborough County, New Hampshire, USA.

9. INVALIDITY OF SPECIFIC TERMS

If any provision of this TOS or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of such documents remain in full force and effect.

10. LIABILITY LIMIT

In no event shall we, our subsidiaries, employees or our suppliers be liable for lost income or profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this agreement (however arising, including negligence).

Our liability, and the liability of our subsidiaries, employees, and suppliers, to you or any third partes in any circumstance is limited to the greater of (A) The amount of fees you pay us in the 3 months prior to the action giving rise to liability, and (B) $20.

11. INDEMNITY

You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
